MN Criminal Restitution Order Can't Consider Victim's Fault, Appeals Court Holds

The State of Minnesota appealed the restitution order in this Winona County criminal case. The trial court had apportioned some of the fault for the assault victim’s injuries to the victim. It had therefore reduced the amount of restitution because the victim was the aggressor in the fight.

The Court of Appeals, in a published decision released on April 7, 2014, held that this was improper, and remanded the case. The court held that the restitution statute, Minnesota Statute 611A.045, did not permit this reduction. The only allowable considerations are the amount of economic loss sustained by the victim as a result of the offense, and the defendant’s income, resources, and obligations. The Court's opinion was authored by Judge Peterson, with Judges Hudson and Stauber concurring.
