Ethics Refresher 2017. Presented by Richard Clem. This will be a comprehensive review of the Rules of Professional Conduct for attorneys in Minnesota and most other states. Many lawyers review the Rules in their entirety only once, and that is before they take the Multistate Professional Responsibility Exam in law school. But the rules change over the years and decades, and some of the finer points might be forgotten. Therefore, this course will serve as a useful refresher for the practitioner to avoid ethical pitfalls.Live lecture, 180 minutes.
Negotiating & drafting commercial leases (Live program by William Seeley): Whether you are representing a landlord or tenant, negotiating and drafting the commercial lease is a crucial contract document. The lease lays out the ground rules spelling out which party pays for which leasehold costs, such as base rent, taxes, insurance, repairs, capital improvements and management fees. Other lease provisions set the legal basis for the Tenants right to freely assign a lease to another party; or the Landlord's rights during and after an eviction proceeding. This presentation is designed to give you some examples of lease language and practice pointers in drafting and enforcing commercial leases. Commercial lenders at times propose the addition of a LETTER OF CREDIT provision which really amounts to a bank approved deposit by the Tenant payable to the Landlord if the Landlord claims Tenant breaches their duty to pay rent, or other lease obligations, in a timely manner. Proposed amounts are often 6 figures. This provision is in addition to TENANT GUARANTEE and SECURITY DEPOSIT. Live lecture, sixty Minutes.
No Fault Arbitration Strategies for Success. (Live program by William Seeley): This one hour program will be an overview of the process for arbitration of Minnesota no-fault hearings. The no-fault arbitration is an informal proceeding with no courtroom, court reporter, or jury. We will cover topics such as medical records, evidence needed to substantiate claims for mileage, wage loss, and replacement services; direct and cross examination; gaps and overlaps in treatment, and other topics. We will cover topics such as key Minnesota court decision to support medical treatment claims, how MN courts deal with multiple accident injury claims, statutory 15% interest claims, evidence needed to substantiate claims for unpaid medical treatment, mileage, etc. Live lecture, sixty minutes.
