Note to Iowa Attorneys: This program has been approved for credit in Iowa and Nebraska, for a total of 5 credits. However, even though the ethics program runs longer than 3 hours, it has only been approved for 1.75 ethics credits in Iowa (it has been approved for 3.5 ethics credits in Nebraska). I normally try to make this program satisfy the entire 3 credit ethics requirement for two years. But this year, you will need to get an additional 1.25 credit elsewhere.

If you attended my 2018 program in Sioux City, or if you attended any other ethics program of at least 1.25 hours during 2018 or 2019, then you'll have plenty of ethics credits. If you are short ethics credit, I have prepared a list of free Iowa ethics CLE programs that you can take online to complete the extra half credit. I will also be sponsoring a series of free ethics conference calls, and will have details available at the program.

Program Description

Conflicts of Interest and Advertising Rules.Live lecture presented by Richard Clem. The program this year will focus on conflicts of interest. We will cover Rule 1.7 of the Rules of Professional Conduct, as well as related rules. Subjects addressed include: Joint representations in general; driver and passenger; co-defendants in criminal cases; insured and insurer; organization and individuals within organization; buyer and seller; testator and beneficiary; closely related entities; business transactions between clients; consent to conflicts; "hot potato" doctrine; and more. We'll also take a detailed look at the rules covering advertising and public communications.

In addition to the ethics program, we will review some recent decisions from appellate courts in Iowa, Nebraska, and around the region. Topics include: search & seizure, choice of evils defense, IA Indian jurisdiction, defamation, overtime, cell site location information, and more.

About the Speaker

Richard P. Clem is an attorney and continuing legal education (CLE) provider in Minnesota. He has been in private practice in the Twin Cities for 30 years. He has a J.D., cum laude, from Hamline University School of Law in St. Paul and a B.A. in History from the University of Minnesota.
