I will also be doing a livestream of this program, which I plan to offer for Iowa and Minnesota credit. Unfortunately, I will not be applying for Nebraska credit for the livestream. This is something of an experiment, and many things can go wrong. Therefore, if you are in the Sioux City/South Sioux City area, I encourage you to come in person.

The livestream program will take place on Facebook live, on my personal Facebook page, along with the cat pictures, political rants, etc. If you go to my Facebook page at noon on Friday, the live video should be at the top of the page. Maybe Facebook won't work. Maybe my phone will run out of data. Maybe my phone's battery will go dead. So if you desperately need one credit, then you should show up in person. But if you can't do that, here's how to watch online:

Why is This Program Free?

This program is absolutely free, and there is no obligation to pay any fee whatsoever. These free CLE programs are an experiment on my part.

I expect that most of the attorneys attending will do so because the program is free, and I honestly don't mind. For some attorneys, the cost of maintaining a license and earning CLE credits can be a significant burden, and I'm glad I'm able to help. But I'm also aware that some businesses are profitable with a "pay as you want" fee structure. This business model has been used successfully in the music industry, by restaurants and even by a taxi company. This article is what gave me the idea to try this.

This model can also work very well for Continuing Legal Education. Even though not all are able, many of the participants in my free programs are willing to make a voluntary payment to support this reasonably priced alternative. Because of the high price of traditional CLE programs, it is my hope that these low-cost programs will be sustainable through voluntary payment. If this method proves successful, then I can continue to make programs, including my popular ethics courses, available on the same "pay as you want" basis.

Therefore, I ask you to consider making a voluntary payment after taking this free program. You may pay whatever you please. The program is free, and zero is a perfectly acceptable option. Of course, if everyone pays zero, my future free programs will be infrequent. You can select any amount you wish. To give you some idea of a reasonable price, please consider the following:

For Iowa attorneys who need additional credits, for only $69, Iowa attorneys can complete their entire 2021 CLE requirement with my 2021 Iowa Season Pass. I will be offering a similar season pass for Nebraska attorneys. Details will follow.

Why I'm Doing This Outdoor Program

I am a firm believer in the importance of social distancing during the current public health emergency. But I also recognize the importance of live interaction. During the height of the pandemic, I was exercising extreme caution and scrupulously avoiding buildings other than my own home. Nonetheless, I presented two live programs in Minnesota during this time. One was an outdoor program in a city park, and the other one was a drive-in program in an office building parking lot.

I am now fully vaccinated, and most attorneys have the opportunity to receive the vaccine, but I am still exercising caution, and I realize there are differing comfort levels. I hope it will soon be possible to present programs in traditional places like libraries and hotel conference rooms, but at this time, that is probably not advisable.

On the other hand, outdoor activities pose little risk. For example, The CDC's recommendation is that "in many areas, people can visit parks, trails, and open spaces as a way to relieve stress, get some fresh air, and stay active."

This program will be conducted in a picnic shelter at Scenic Park in South Sioux City. This is an open-air shelter with a roof, so the program can take place rain or shine. In addition, upon request, the program can be viewed from the parking lot, and you would listen on your car radio.

Wisconsin: CLE credit applied for upon request.
Other States: Eligible for CLE credit in most states. Please contact me regarding credit in other states.

Program Description

Recent Appellate Decisions.Live lecture presented by Richard Clem. This program will review recent decisions from appellate courts in Nebraska and Iowa and, if time permits, other courts around the region. Topics include: Negligence duty, property tax, restraint on alienation, hearsay, defamation, electronic filing, municipal liablity, adverse possession, speedy trial, and more.

About the Speaker
