Program Description

Conflicts of Interest. Conflicts of Interest.Live lecture presented by Richard Clem. This will be a look at the conflict of interest rules governing lawyers in Iowa and other states. It will cover Rule 1.7 of the Iowa Rules of Professional Conduct, as well as related rules. Subjects addressed include: Joint representations in general; driver and passenger; co-defendants in criminal cases; insured and insurer; organization and individuals within organization; buyer and seller; testator and beneficiary; closely related entitites; business transactions between clients; consent to conflicts; "hot potato" doctrine; and more.Live lecture, 210 minutes.

How to Work With Interpreters. Live lecture presented by Richard Clem and Yippy Clem. Precise communication is important for attorneys, and when working with Limited English Proficient (LEP) individuals, precise communication is a challenge. We will learn the difference between certified, rostered, and casual interpreters. We will learn how the LEP person's expectations of the U.S. legal system can affect communication. And we will learn the specifics of your interpreted encounter, as well as practical tips that will make communications easier and clearer. Live lecture, 90 minutes.

About the Speakers

Richard P. Clem is an attorney and continuing legal education (CLE) provider in Minnesota. He has been in private practice in the Twin Cities for over 30 years. He has a J.D., cum laude, from Hamline University School of Law in St. Paul and a B.A. in History from the University of Minnesota. His reported cases include: Asociacion Nacional de Pescadores a Pequena Escala o Artesanales de Colombia v. Dow Quimica de Colombia, 988 F.2d 559, rehearing denied, 5 F.3d 530 (5th Cir. 1993), cert. denied, 510 U.S. 1041 (1994); LaMott v. Apple Valley Health Care Center, 465 N.W.2d 585 (Minn. Ct. Yippy G. Clem is a native of Mexico and graduate of both a U.S. high school and a Mexican college. She is an Spanish-language translator and interpreter, primarily in the areas of health care and education. She is on the Minnesota Department of Health Spoken Language Interpreter Roster
